Release-review draft
These documents are being reviewed before release. They do not certify EU compliance; required operator disclosures and the service’s privacy practices still need to be verified.
A shared plan works when everyone has clear boundaries.
Use Gatherory lawfully, respect the people you invite, and only share content you have the right to use. You keep ownership of your content; you give us the limited permission needed to operate the service.
1. Agreement
These Terms are an agreement between you and Guide Systems LLC, established in the United States, which operates Gatherory. “Gatherory,” “we,” “us,” and “our” refer to that operator. The Terms apply to our websites, applications, and related services.
By creating an account or using the service where these Terms apply, you agree to them and acknowledge our Privacy Policy. That acknowledgment is not consent to optional analytics, marketing, or unrelated use of personal data. If you do not agree to the Terms, do not use the service.
If you use Gatherory for an organization, you represent that you have authority to accept these Terms for that organization.
2. Accounts and eligibility
You must be at least 13 and meet any higher age requirement that applies where you live. If you cannot legally enter this agreement on your own, a parent or legal guardian must authorize it where the law permits. Rules for a child’s consent to personal-data processing are separate; where verified parental consent is required and no appropriate process is available, you must not use the affected feature.
Provide accurate account information, keep your credentials confidential, and notify us promptly if you believe your account has been compromised. You are responsible for activity under your account unless applicable law says otherwise. We may require email verification or other reasonable steps to protect an account.
3. Using Gatherory
Gatherory provides tools for creating events, shaping ideas, making decisions, coordinating schedules, inviting people, managing attendance, and keeping related details together. Features and permissions may differ for hosts, collaborators, and guests.
You are responsible for how you configure an event, who you invite, and the accuracy of information you provide. Gatherory supplies planning tools, not the venues, travel, gifts, or other arrangements you make with third parties. This distinction does not exclude responsibility for our own service or remove mandatory consumer rights.
4. European consumer rights
If you use Gatherory as a consumer in the EU or EEA, mandatory protections under the laws applicable to you take priority over inconsistent wording in these Terms. A service being free of charge does not by itself remove those protections.
Where applicable digital-service law gives you rights concerning supply, conformity, necessary updates, correction of faults, termination, reimbursement, or retrieval of content, these Terms do not exclude them. Nor do they waive a statutory withdrawal right. Contact [email protected] about a problem or remedy.
No arbitration requirement, waiver of access to courts, or blanket surrender of privacy rights is imposed by these Terms. The liability provisions below cannot override protections that the law makes mandatory for consumers.
5. Your content
You retain ownership of the content you submit, including plans, notes, images, and invitations. You grant us a worldwide, non-exclusive, royalty-free license limited to hosting, processing, reproducing, displaying, and transmitting that content to provide and secure the features you choose and the sharing you authorize.
This is not permission to sell your private event content, use it in unrelated advertising, or train unrelated AI models on it. Processing personal information still requires an appropriate lawful basis; the content license is not a waiver of data-protection rights.
The license ends when the content is deleted, except to the limited extent storage or continued use is lawful and necessary for backups, legal obligations, or shared content that other participants are entitled to keep. You must have the rights and lawful basis needed to submit other people’s images or personal details. Rights to deletion, restriction, and retrieval under applicable law take priority.
6. Invitations and collaboration
When you invite someone, assign a role, or share event content, that person may be able to view or change information according to the permissions you select. Review an event’s participants and visibility before adding private or sensitive information.
Anyone-with-the-link invitations can be forwarded. People admitted through them receive the chosen access level; revoking a link cannot retrieve copies already saved by another person. A host should share only the information needed by that audience.
Do not invite people without a legitimate reason or use Gatherory to send unwanted messages. If someone invites you, the event host—not Gatherory—is responsible for the event and the content they choose to share.
7. Acceptable use
You may not use Gatherory to:
- break the law, violate another person’s rights, or facilitate harmful or fraudulent activity;
- upload content that is unlawful, abusive, deceptive, infringing, or invasive of privacy;
- harass people, send spam, or collect personal information without permission;
- gain unauthorized access to accounts, events, systems, or data;
- interfere with the service, bypass access controls, introduce malicious code, or place an unreasonable load on our systems;
- reverse engineer or copy the service except where applicable law permits it; or
- resell or commercially exploit Gatherory unless we agree in writing.
8. Third-party services
You may choose to sign in with or use providers such as Apple or Google, map or music features, and external event links. Their services have separate terms and policies. We do not control their content or availability, but remain responsible for our own legal obligations when integrating or processing data through them.
9. Gatherory’s rights
Guide Systems LLC and its licensors own the service’s software, design, branding, and documentation. These Terms give you a limited, non-transferable right to use the service for its intended purpose, subject to the suspension and termination rules below. They do not transfer ownership rights to you.
If you send feedback or suggestions, you permit us to use them without restriction or compensation, but you are not required to provide feedback.
10. Changes and availability
We may make reasonable changes for security, legal compliance, compatibility, or service improvements. We aim for reliable operation but cannot guarantee an absence of outages. This does not limit a consumer’s statutory entitlement to a conforming service or necessary updates.
For material changes to the service or these Terms, we will explain the reason, effect, and effective date with advance notice where required, using a form you can retain when the law requires it. Urgent security or legal measures may need to take effect sooner.
If a change negatively affects your access or use beyond what applicable law permits, any statutory right to reject the change, end the contract without charge, or retrieve your content remains available. Continued use alone does not waive those rights or supply any separate consent required by law.
11. Suspension and termination
You may stop using Gatherory or request account deletion at any time. We may restrict access for a material or repeated violation, a legal requirement, or a concrete security or safety risk. Restrictions should be proportionate. Unless law or an urgent risk prevents it, we will explain the reason and give an opportunity to resolve or challenge it through [email protected].
Where the law requires it, you may retrieve qualifying content after termination within a reasonable time, free of charge and in an appropriate format, subject to legal exceptions. Account deletion does not erase all contributions belonging to other participants. Our Privacy Policy explains retention and shared records.
Terms that by their nature should continue after termination—including ownership, disclaimers, limits of liability, and general provisions—will remain in effect.
12. Disclaimers and statutory guarantees
We do not promise that the service will suit every plan or preserve content indefinitely. For business users, and only to the extent permitted by applicable law, the service is supplied “as is” and “as available” without implied warranties.
That business-user disclaimer does not apply to statutory consumer guarantees. In particular, European consumers retain applicable rights concerning conformity, supply, security updates, and remedies. No disclaimer excludes rights or obligations that cannot lawfully be excluded.
13. Liability
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any other responsibility that cannot lawfully be excluded or limited. Statutory data-protection remedies and mandatory consumer rights are preserved.
If you are a consumer, our responsibility is determined by the applicable law; the business-user exclusions and cap below do not apply to you.
For business users only, to the extent permitted by law, we exclude indirect or consequential losses and losses of profit or opportunity. Our total liability for claims relating to the service is limited to the greater of the amount paid to us for it in the 12 months before the claim or US$100, except for the non-excludable responsibilities stated above.
14. General terms and disputes
You remain responsible under applicable law for unlawful content and misuse. These Terms do not impose a blanket duty on consumers to indemnify us for every third-party claim.
If a provision of these Terms is unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, or sale of the business.
Applicable conflict-of-law rules determine governing law. These Terms do not deprive an EU or EEA consumer of mandatory protections available under the law of their habitual residence, or of access to a competent court there where the law provides it.
We welcome an opportunity to resolve a concern by email, but contacting us first is not a condition of seeking a court remedy, urgent relief, or a complaint to a competent regulator. No exclusive US court or mandatory arbitration venue is imposed.
